KRAUTHAMMER: How fractured is the GOP?

WASHINGTON ? A combination of early presidential maneuvering and internal policy debate is feeding yet another iteration of that media perennial: the great Republican crackup. This time it?s tea party insurgents versus get-along establishment fogies fighting principally over two things: (a) national security and (b) Obamacare.

National security

Gov. Chris Christie recently challenged Sen. Rand Paul over his opposition to the National Security Agency metadata program. Paul has also tangled with Sen. John McCain and other internationalists over drone warfare, democracy promotion and, more generally, intervention abroad.

So what else is new? The return of the most venerable strain of conservative foreign policy ? isolationism ? was utterly predictable. GOP isolationists dominated until Pearl Harbor and then acquiesced to an activist internationalism during the Cold War because of a fierce detestation of communism.

With communism gone, the conservative coalition should have fractured long ago. This was delayed by 9/11 and the rise of radical Islam. But now, 12 years into that era ? after Afghanistan and Iraq, after drone wars and the NSA revelations ? the natural tension between isolationist and internationalist tendencies has resurfaced.

In fact, both parties are internally split on domestic surveillance, as reflected in the very close recent House vote on curbing the NSA. This is not civil war. It?s a healthy debate that helps recalibrate the delicate line between safety and security as conditions (threat level and surveillance technology, for example) change.

The more fundamental GOP divide is over foreign aid and other manifestations of our role as the world?s leading power. The Paulites, pining for the splendid isolation of the 19th century, want to leave the world alone on the assumption that it will then leave us alone.

Which rests on the further assumption that international stability ? open sea lanes, free commerce, relative tranquility ? come naturally, like the air we breathe. If only that were true. Unfortunately, stability is not a matter of grace. It comes about only by Great Power exertion.

In the 19th century, that meant the British navy, behind whose protection America thrived. Today, alas, Britannia rules no waves. World order is maintained by American power and American will. Take that away and you don?t get tranquility. You get chaos.

That?s the Christie/McCain position. They figure that America doesn?t need two parties of retreat. Paul?s views, more measured and moderate than his fringy father?s, are still in the minority among conservatives, but gathering strength. Which is why Christie?s stroke ? defending and thus seizing the party?s more traditional internationalist consensus ? was a signal moment in the run-up to the 2016 campaign. The battle lines are drawn.

Obamacare

The other battle is about defunding Obamacare. Led by Sens. Mike Lee and Ted Cruz, the GOP insurgents are threatening to shut down the government on Oct. 1 if the stopgap funding bill contains money for Obamacare.

This is nuts. The president will never sign a bill defunding the singular achievement of his presidency. Especially when he has control of the Senate. Especially when, though a narrow majority (51 percent) of Americans disapprove of Obamacare, only 36 percent favor repeal. President Obama so knows he?ll win any shutdown showdown that he?s practically goading the Republicans into trying.

Never make a threat on which you are not prepared to deliver. Every fiscal showdown has redounded against the Republicans. The first, in 1995, effectively marked the end of the Gingrich revolution. The latest, last December, led to a last-minute Republican cave that humiliated the GOP and did nothing to stop the tax hike it so strongly opposed.

Those who fancy themselves tea party patriots fighting a sold-out cocktail-swilling establishment are demanding yet another cliff dive as a show of principle and manliness.

But there?s no principle at stake here. This is about tactics. If I thought this would work, I would support it. But I don?t fancy suicide. It has a tendency to be fatal.

As for manliness, the real question here is sanity. Nothing could better revive the fortunes of a failing, flailing, fading Democratic administration than a government shutdown where the president is portrayed as standing up to the GOP on honoring our debts and paying our soldiers in the field.

How many times must we learn the lesson? You can?t govern from one house of Congress. You need to win back the Senate and then the presidency. Shutting down the government is the worst possible way to get there. Indeed, it?s Obama?s fondest hope for a Democratic revival.

Tomopop Review: Hot Toys Agent Phil Coulson - TOMOPOP

I said to myself while watching The Avengers that if Hot Toys were to make a figure of Agent Coulson, I would buy it. Sure enough, $179.99 plus shipping later, I would keep that promise. Hot Toys has a reputation, and I fully bought into it. While Coulson lives, is he worth the price? Find out in the review of Hot Toys' Agent Phil Coulson.

Going with standard protocol, here's a look at the cover slip for Agent Phil. As with all of Hot Toys' Avengers releases, you have the faded dot print, this time in blue, and the shot of Coulson himself. The name at the top and bottom of the boxes follows the standard as well. Along the sides are a small S.H.I.E.L.D. emblem.

Taking the cover off, you're treated to the goods. The most enticing part of any Hot Toys release are the accessories included. As for hands, you'll get an extra pair of trigger hands as well as a right hand for holding the best accessory, a set of Captain America vintage trading cards. Also included in the package are a S.H.I.E.L.D. dossier, watch, eyeglasses, cellphone, headset, walkie-talkie and I.D. card.

For Coulson himself, it is Hot Toys' usual effort in terms of detail. The suit fits perfectly, but you won't be able to close the jacket. Coulson is meant to be displayed in action, so much so that the tie is fixed to be uneven. Even though the articulation is top-notch, however, there is one contention that I have to make.

As you can tell, there is no range of motion for the head on its own. It's a single piece with the neck, so if you want to move it up or down, you're out of luck. It doesn't really limit too much of what you can do, but it is a bit disappointing.

While we're here, the facial sculpt is the usual Hot Toys quality. Each wrinkle and blotch of skin matches up with the likeness of Clark Gregg. Also in this shot you get a look at the headset and glasses. I will say though that the headset is a bit difficult to get in. Whatever you do, please put this on somewhere that isn't carpet. It will disappear forever should it fall in the carpet.

The big attraction though is the big gun. It features an LED in the barrel, giving it the effect of preparing to be fired. The gun is immensely detailed. From the scope to the weathering effects along the gun, it's the accessory that has to be displayed. The hands are able to hold both handles of the gun tightly and isn't too heavy to make the joints weaken. The only problem, no fault of the gun itself, is that you can't pose him looking through the scope. That's the problem created by the lack of an upper neck joint and not positioning of the rifle.

My favorite part of this figure is the smallest detail, the vintage Captain America cards. The detail on these is incredible at the scale they are. Each card is printed as it was in the movie. As you can tell, there's a bit of blood in the right hand corner of each card. I wish they would have included a clean version of the cards, but I am definitely glad they included them at all.

Another example of the detail is the I.D. card. As you see in the picture, it fits nicely into his jacket pocket. It's honestly scary how clear the I.D. is at that scale. You can read everything on the card, not to mention a clear picture of the man himself. Also in this shot, you can make out the stitching and buttons on the shirt along with the pattern on the tie.

Taking a final look at Coulson, it is the usual standout effort from the company. It is Hot Toys, you know what you are getting here. The accessory count may not be the highest, but the ones included are worth the price of entry. I knew from the beginning that I wanted Agent Coulson and I don't regret the purchase one bit. He may not have a suit of armor, a hammer, or shield, but this was the Avenger I had to have and am glad I do.

Glaciers protect Alps mountain peaks

Instead of wearing mountains down, evidence from Europe's high Alps shows that glaciers shield summits from erosion, acting as a protective lid.

French scientists studied erosion on Mont Blanc, western Europe's highest peak, below and around its glaciers.

Cold ice at the highest points froze to the mountain rock and played little part in erosion, the team said.

In contrast, water and rain eroded glacier-free areas 10 times faster than areas protected by the glacier.

The research was part of C?cile Godon's doctoral research at Universit? de Savoie, located on the edge of the French Alps, and appeared in the journal Earth and Planetary Sciences Letters.

The study focused on the Bossons glacier, which flows down the northern face of Mont Blanc towards the French town of Chamonix.

Rock debris, carved from the mountain at the toe of the Bossons glacier and sediments washed out in high mountain streams were compared with erosion in nearby glacier-free areas.

The researchers found that the cold glacial ice protected the mountain from erosion, rather than promoting it.

Rising ice

These results may explain the high altitude of the Alps. Driven by the tectonic collision of Europe with Africa, the high alpine bedrock is rising about one millimetre each year.

Glacier-free areas of the Alps erode at a similar rate but where the mountains are protected by ice, the peaks wear away at one tenth that rate.

Fritz Schlunegger, from Bern University, Switzerland, was not involved in the work and commented: "This group has used sediments at the end of Bossons glacier to determine where erosion is happening beneath the ice.

"Most material has been derived from the non-frozen part the glacier, while higher up towards (the summit of) Mont Blanc - where the glacier is frozen to the ground - erosion is much less," he told BBC News.

"This is really the first time, according to my knowledge, where this has been convincingly shown in a quantitative way and using a natural example.

"However, mountains don't grow to infinity, so there must be another mechanism which has lowered the summit of Europe. According to (Dr) Godon's findings, this erosion is not related to glaciers, so we still have to think about other possibilities."

Around the globe, mountain glaciers - especially those at low latitudes - are retreating in response to climate change, scientists say.

Reports earlier this year indicated that glaciers around Mount Everest had lost more than one eight of their area in the past 50 years, and the snowline had retreated 180 metres up the mountain sides.

Dr Godon's results suggest that changes like these could change the shapes of the world's highest mountains, and that climate and mountain landscape are intimately linked.

This week has been about adjusting to an MMA world where Anderson Silva is not the UFC's middleweight champ. Who had a good week, and who didn't?

Hot -- Chris Weidman: After winning the UFC middleweight belt by knocking out Anderson Silva in a shocking fashion, he celebrated in Las Vegas before heading home to New York. He then went on to a media tour and got to relish his victory.

Not -- The jerkfaces who forced Invicta's Ashley Cummins to close her Twitter and Facebook accounts: In addition to being a fighter, Cummins is a police officer. After she lost in October, she told Bleacher Report she was inundated with anti-law enforcement messages and even death threats on Facebook and Twitter. It takes a special kind of coward to go after someone you don't know who puts her life on the line to keep others safe. Brad Keselowski is back on top of NASCAR.

Well, for a race, at least.

But he's quickly running out of time to make it back to the Chase for the Sprint Cup championship and defend his series championship.

His first pole of the season might give his season the boost he needs to become a contender. Keselowski turned a lap of 135.922 mph on Friday to set a track record at New Hampshire Motor Speedway.

Keselowski won only his third career pole and first since 2011. With eight races left until the 12-driver Chase field is set, Keselowski is winless and sitting in an uncomfortable 13th place in the points standings.

''There is a sense of urgency but not a sense of panic,'' Keselowski said. ''I think there is a strong difference between the two. We are eager to get going, we are hungry and feel like we can do it but I don't feel a sense of panic. There are still two months of racing essentially to get into the Chase.''

Keselowski led a fast day at the track as nine drivers topped the previous track record held by Ryan Newman, who went 135.232 in 2011.

Ten drivers topped that lap until points leader Jimmie Johnson's second-fastest qualifying time was scrapped after his car failed inspection. His No. 48 Chevrolet, which had two issues in the pre-qualifying inspection, failed after his attempt because both sides of the front were too low. He'll start in the rear in 43rd.

''We were able to get the car right,'' crew chief Chad Knaus said. ''just not exactly right.''

Johnson will actually start behind 71-year-old Morgan Shepherd. Shepherd will become the oldest driver to start a NASCAR Sprint Cup race.

Shepherd, who went only 128.290 in qualifying, made his Cup debut in 1970 and won four times in NASCAR's top series. He finished as high as fifth in the final standings in 1990 and hasn't started a race since 2006.

Four-time Cup champion Jeff Gordon had no problem with Shepherd competing on Sunday.

''I think that's quite an accomplishment,'' Gordon said. ''We talk about how amazing it is to see Mark Martin out there being competitive over 50 years old, but to just go out there and do what he does as far as Morgan is concerned at 71, that's amazing.''

Jim Fitzgerald when he was 65 years, 6 months and 20 days when he raced in 1987 at Riverside International Raceway.

''At some point, I think you just have to trust that he knows what he can do and what he can't do,'' Keselowski said.

Kurt Busch will now join Keselowski on the front row. Dale Earnhardt Jr., Kyle Busch and Gordon round out the top five. Carl Edwards, Denny Hamlin, Kasey Kahne, and Jeff Burton all topped Newman's record.

Keselowski won five races this season but lost his consistency this season in the No. 2 Ford. He has three straight finishes of 21st or worse and only one top-10 finish in his last 10 races.

Whatever worked for Keselowski last season is gone. His team has been in a tailspin since a failed April inspection in Texas after NASCAR confiscated parts in the rear suspensions of his Ford.

Keselowski knows a win or two can propel him back into the Chase and keep alive his bid for a second straight title.

''I still have the same goal and that is to continue to be a winner and that is what fuels me inside,'' he said. ''The competitive fire that burns inside of me is still there whether I was a champion or not. I probably have it with a little bit more confidence and I believe in myself and those around me a little stronger because of the championship.''

The long-expected Stewart-Haas Racing shakeup was finalized Friday. Kevin Harvick and his Budweiser sponsorship will join SHR teammates Tony Stewart and Danica Patrick in 2014. Ryan Newman is out of the New Hampshire record book - and a job at SHR.

Newman (15th) and Stewart (16th) actually start on the same row. Harvick starts 18th and Patrick is 32nd.

There was at least one palatable shift with Harvick's move ? Stewart might have to crack open a cold Bud to celebrate.

For years, he's been an open admirer ? and frequent chugger ? of low-budget Schlitz.

''Yeah, I'm finally upgrading to the good stuff,'' Stewart said. ''I feel like `The Jeffersons' now. I've moved up. Yeah, it's the end of my Schlitz era. I can't say that it's terribly disappointing. Now I get to drink the good stuff every day, guilt free.''

At least 31 people dead in western China flooding

BEIJING (AP) ? Floodwaters surging through Himalayan foothills in western China have swept bridges, houses and hillsides into roiling brown torrents, leaving at least 31 people dead and 166 missing Thursday, as heavy rains buffeted many parts of the country.

Flooding in the western province of Sichuan was the worst in 50 years for some areas, with more than 220,000 people forced to evacuate.

Nationwide, at least 46 people have died due to the violent weather since Sunday, according to figures from the Ministry of Civil Affairs and the official Xinhua News Agency. Thousands of homes have been destroyed or damaged and transportation has come to a virtual standstill in hard-hit areas.

Many of the casualties in Sichuan were from a massive landslide that struck a scenic resort outside the city of Dujiangyan, killing 18 people and leaving 107 missing. An entire hillside collapsed onto clusters of holiday cottages where city dwellers escape summer heat, a survivor told Xinhua.

"The noise was like thunder and went on for two or three minutes. My first thought was that I too would be buried," Gao Quanshi, 47, was quoted as saying. Phone lines were cut, so villagers had to trek to nearby government offices to call for help, he said.

Images from the scene showed a valley filled with mud and rocks, with only the tops of trees sticking through. Drenched rescuers wearing helmets and life jackets worked mostly with hand tools to prevent harming any survivors still trapped beneath.

A total of 352 tourists had been rescued from the area as of Wednesday night, Xinhua said. Overall in Sichuan, there were at least 31 people dead and 166 missing, said the provincial department of civil affairs.

A mudslide in Sichuan's Aba prefecture left three people dead and 12 others missing, Xinhua said.

Mudslides and flooding are common in China's mountainous areas, killing hundreds of people every year, but in some areas the current floods are already the worst in half a century. Reports said the 94 centimeters (37 inches) of rainfall that fell on Dujiangyan over 40 hours beginning Monday was the heaviest since records began being kept in 1954.

Also in the west, more than 2,000 people were rescued after being trapped for several hours Wednesday in a highway tunnel between Dujiangyan and Wenchuan ? the epicenter of the Sichuan earthquake five years ago that left 90,000 people dead or missing.

Bridges have been closed and train service suspended in some parts of the province.

In nearby Beichuan county, flooding destroyed buildings and wrecked exhibits at a memorial for earthquake victims.

The flooding also caused the collapse of an almost 50-year-old bridge in a neighboring county, sending six vehicles into the raging waters and leaving 12 people missing.

The region lies in the foothills of the Tibetan Plateau, where mountains rise sharply from the densely populated Sichuan basin. Fast-running rivers quickly overflowed their banks, flooding scores of towns and parts of the provincial capital of Chengdu, where the waters rose to the second floor and covered the tops of cars.

In Chengdu, stone bridges and brick houses along river banks were swept away, including one in which the residents were taking shelter, while others crumbled into the saturated earth already rent with fissures from the magnitude-8.9 2008 earthquake.

In the northern province of Shanxi, at least 12 workers were killed Tuesday when a violent rainstorm caused the collapse of an unfinished coal mine workshop they were building.

Another three people were drowned in a car in Hebei province outside the capital, while an additional 11 people were reported dead or missing in Yunnan province, Beijing, Inner Mongolia and Gansu province.

Nokia's Lumia 1020 has finally gone official today and, no surprise here, it's all about imaging. To complement the handset's 41-megapixel BSI sensor and accompanying ProCamera software, Nokia's released an imaging SDK to devs that want to impose their own camera customizations. As of now, the Finnish company's seeded the SDK out to the likes of CNN, Vyclone, Panagraph, Snapcam, Foursquare, Hipstamatic's Oggl Pro, Yelp, Flipboard and Path -- all of which have already been working on custom applications for the 1020. So what does that mean for the end user? Most likely, these third-party tweaks will entail high-res photo sharing and custom filters, as in the case of Path's Lumia app. Nokia's posted the SDK on its site for all developers today, so if you're interested in seeing what the Lumia 1020's beastly sensor can do for your app or what its SDK can do for WP8 apps in general, you know where to look.

Jury selection moves forward in Fort Hood shooting trial

FORT HOOD, Texas (Reuters) - Jury selection progressed on Wednesday in the murder trial of an Army Major accused of killing 13 U.S. soldiers at a Texas base in 2009.

Ten Army officers were chosen by the end of the day of the 13 to 16 expected to form the jury in the court martial of Major Nidal Hasan, who faces the death penalty if convicted.

Hasan, an American-born Muslim who is defending himself, asked one of the prospective jurors his opinion about the Taliban in Afghanistan.

The prospective juror said he viewed the Taliban as part political and social, conservative, tribal, strict and intolerant.

Another potential juror who said he was at the Pentagon during the September 11, 2001, attacks, was asked by Hasan his opinion about Sharia or Islamic law. The colonel said he did not see Sharia law as aligned with democratic principles.

It was not clear if the two officers questioned about the Taliban and Sharia were selected for the jury.

Hasan has said that he opened fire at the base on November 5, 2009 to protect Muslims and the Taliban in Afghanistan from U.S. aggression. He was shot by civilian base police during the attack and is paralyzed from the chest down.

Fort Hood was a major deployment point for the wars in Iraq and Afghanistan. The attack happened at a readiness facility where soldiers prepare to be deployed and Hasan himself was preparing to deploy to Afghanistan with a unit assigned to help soldiers deal with mental health issues.

The case, which has been delayed by unusual turns including arguments over whether Hasan could keep a beard against Army regulations and represent himself, is advancing toward opening statements now set for no earlier than August 6.

Hasan and prosecutors questioned officers individually on Wednesday. Afterward, the military judge, Colonel Tara Osborn, said that 10 had been selected for the panel.

The jury will decide whether Hasan is guilty of premeditated murder and premeditated attempted murder in the shooting that left 13 people dead and 32 wounded.

Osborn said court would resume on Monday to select the remaining jurors, all of whom must be of superior rank to Hasan. The names of the selected officers, who were excused from court until August 6, were not released.

Osborn has allowed Hasan to wear the beard for religious reasons. He has been allowed to wear a combat camouflage uniform, rather than a dress uniform, for medical reasons.

Witnesses say he shouted in Arabic "God is greatest" while firing the gun in 2009. He has told the court he spends hours reading the Koran in his cell every day.

If he gets the death penalty, Hasan would go to the military version of Death Row, at Fort Leavenworth, Kansas. The last court martial execution in the United States was in 1961. Hasan could also be sentenced to life without parole, or be found guilty on lesser charges.

12 Texas CEOs exit in June

Marathon Oil Corp.'s Clarence Cazalot Jr. was one of two Houston-based CEOs to announce departures in June.

As national CEO turnover dipped in June, 12 Texas executives were among those departing, a report from outplacement firm Challenger, Gray & Christmas Inc. shows.

Nationwide, 94 CEOs left their posts in June, down 9.6 percent from 104 in May and down 5 percent from 99 in June 2012, according to the Chicago-based firm.

Two of those departures came from Houston.

Clarence Cazalot Jr. said in June he will retire as Houston-based Marathon Oil Corp.?s (NYSE: MRO) chairman, president and CEO at the end of this year. Exxon Mobil Corp.?s (NYSE: XOM) Lee Tillman will become president and CEO effective Aug. 1.

Rick Stein left his role as CEO of UHY Advisors-TX LLC, a Houston-based professional services firm, though he will retain his chairman post and his position as co-CEO of Chicago-based UHY Advisors Inc., the parent company of UHY Advisors-TX. Ron Martin succeeds Stein as CEO of the Houston-based firm.

For the second quarter, nationwide CEO departures totaled 292, down 10 percent from the 309 recorded in the first quarter but virtually unchanged from the 288 departures announced in the same quarter a year earlier. In the first six months of 2013, departures totaled 601, nearly equal to the 609 recorded in the same period a year earlier.

Gov. Rick Perry Says He Won't Seek Re-election In Texas

Texas Gov. Rick Perry says he will not run for re-election in 2014, feeding speculation that he might again pursue the presidency as a Republican candidate in the 2016 race.

The governor made his announcement at a news conference Monday in San Antonio, which was carried live online by The Texas Tribune.

He said he would use the next 18 months to think about his next moves. On FOX News Sunday, he answered a question about a potential presidential run from by saying, "Well, certainly, that's an option out there."

Making his announcement Monday, Perry said he would make any other information public "in due time."

In his speech, Perry touted his record on economic issues, particularly in creating new jobs. More than once, he referred to the slogan, "Texas Works."

Across the country, this week's landmark Supreme Court rulings on same-sex marriage have energized activists and politicians on both sides of the debate. Efforts to impose bans ? and to repeal them ? have taken on new intensity, as have lawsuits by gays demanding the right to marry.

The high court, in two 5-4 decisions Wednesday, opened the way for California to become the 13th state to legalize gay marriage, and it directed the federal government to recognize legally married same-sex couples.

But the rulings, while hailed by gay-rights activists, did not declare a nationwide right for gays to marry. Instead, they set the stage for state-by-state battles over one of America's most contentious social issues. Already, some of those battles are heating up.

In Pennsylvania, the only Northeast state that doesn't legally recognize same-sex couples, gay state Rep. Brian Sims, a Philadelphia Democrat, says he will introduce a bill to allow same-sex marriages. The bill may flounder in the GOP-led Legislature, but the issue is likely to be volatile in next year's gubernatorial race, pitting GOP Gov. Tom Corbett, an opponent of gay marriage, against any of three Democrats who favor it.

In Arizona, gay-rights supporters have begun circulating petitions aimed at repealing the state's 2008 ban on same-sex marriage by way of a ballot measure next year. With California's ban in the process of being quashed, Arizona is now among 29 states with constitutional amendments that limit marriage to one-man, one-woman unions.

Gay-rights activists and Democratic politicians in several other states also hope to repeal the bans in their states ? in Oregon, Ohio and Arkansas with possible ballot measures next year, and in Nevada and Michigan with referendums in 2016.

Ohio activist Ian James of FreedomOhio said his group's resolve to collect signatures "has been doubled" as a result of the Supreme Court decisions. And Oregon Gov. John Kitzhaber, a Democrat who favors repealing his state's ban, said the court action "underscores the urgency of extending the freedom to marry to all our citizens."

"Oregon has not yet lived up to the ideal of equal rights for all," Kitzhaber said.

In Indiana and West Virginia, some Republican politicians want to move in the other direction, joining the ranks of states with constitutional bans. Both states have laws that bar gays from marrying, but constitutional amendments are viewed as more durable measures that resist being overturned by litigation.

The leaders of Indiana's Republican-controlled Legislature had deferred action on an amendment during this year's session, opting to wait for the Supreme Court rulings. Now, with the backing of GOP Gov. Mike Pence, they say the Legislature will consider the ban in the session starting in January, possibly putting the question to voters later next year.

Micah Clark, executive director of the conservative American Family Association of Indiana, was pleased by that prospect.

"The future of marriage matters," he said. "And it belongs in the hands of Hoosier voters, not the courts, not Hollywood, and not the activists seeking to change it from what it is and always has been."

West Virginia, like Indiana, has a state law prohibiting gay marriages. Until now, though, it has not joined the parade of states taking a further step with a constitutional amendment. After the Supreme Court rulings, the leader of the large Republican minority in the House of Delegates suggested there is now an urgent need for an amendment,

"We don't know when someone might file a lawsuit or have some other issue come up where a judge can review that," said Tim Armstead. "We need to go to the next step."

Democratic Delegate Stephen Skinner, West Virginia's first openly gay lawmaker, disagreed. "There's really not much reason for a constitutional amendment, except to promote discrimination and promote homophobia," he said.

National gay-rights leaders expect that lawsuits seeking to expand gay marriage rights will eventually bring the issue back to the Supreme Court in a quest for a ruling that would establish a 50-state policy.

Lawsuits already are pending in a number of states. Some of those involved were heartened by the past week's rulings.

"What this does is establish very, very powerful precedents that we will be able to use in our case," said Mark Lawrence of Restore Our Humanity, which is backing a legal challenge by three same-sex couples to a ban approved by Utah voters in 2004.

Michigan's constitutional ban, also approved in 2004, is the target of a pending lawsuit by Detroit-area nurses April DeBoer and Jayne Rowse seeking a right to jointly adopt each other's children. The federal judge hearing the case had been waiting for the Supreme Court before issuing a judgment.

In New Mexico, two gay men from Santa Fe asked the state Supreme Court on Thursday to decide whether same-sex marriage is legal. The lawsuit contends that denying marriage licenses to same-sex couples violates the state constitution, including provisions prohibiting gender-based discrimination and guaranteeing equal protection under the law.

New Mexico is one of only five states ? along with West Virginia, Pennsylvania, Wyoming and Indiana ? that has neither extended legal recognition to gay couples nor enacted a ban-gay-marriage constitutional amendment. There also is litigation in three states offering civil unions to gay couples, providing the rights and responsibilities of marriage but not extending that title.

In New Jersey, one lawsuit contends that civil unions do not fulfill a state Supreme Court mandate from 2006 that gay couples receive equal treatment to married heterosexual couples. The plaintiffs say they will soon file a motion arguing that, in light of the Supreme Court ruling, the only thing that is keeping the couples from equal treatment is the state law.

New Jersey's Democratic-majority Legislature passed a bill last year to legalize gay marriage, but it was vetoed by Republican Gov. Chris Christie. He says the matter should be decided in a referendum.

"There is no longer any excuse to delay," said Troy Stevenson of the gay-rights group Garden State Equality. "It is as immoral as it is impractical to force any New Jersey family to be stripped of critical economic and legal protections every time they cross the Hudson or Delaware Rivers."

Hawaii's civil union law, adopted in 2011, is being challenged in federal court by two women who want to marry rather than enter into a civil union. Democratic Gov. Neil Abercrombie, who supports a right to same-sex marriage, says the Supreme Court ruling on federal benefits for same-sex couples bolsters his argument.

Illinois also allowed civil unions in 2011, but efforts to legalize same-sex marriage in the recently ended legislative session fell short. The sponsor of the measure, Democratic Rep. Greg Harris, said the Supreme Court rulings should bolster efforts to revive the bill in the fall session.

Meanwhile, gay-rights lawyers are pressing ahead with a lawsuit on behalf of more than two dozen same-sex couples who were denied marriage licenses in Cook County. The suit also challenges an Illinois law that defines marriage as between a man and woman.

Gay-rights activists in some conservative states say there is no near-term prospect for softening their states' gay-marriage bans, and they're looking toward a more incremental approach.

In states such as Georgia, Idaho and Louisiana, these efforts include lobbying for local and statewide anti-discrimination laws that would extend protections to gays and lesbians.

In Wisconsin, a state that has tilted Democratic in national elections, Republicans now hold power at the Statehouse, and there's little discussion by gay-rights supporters of mounting an effort to repeal the gay-marriage ban approved by voters in 2006.

Instead, gay-rights activists there are trying to defeat a conservative group's lawsuit challenging a 2009 domestic partnership law that ended some legal rights to same-sex couples.

Wyoming has no constitutional ban on same-sex marriage, but proposals to permit civil unions and to ban discrimination against gays died in the latest legislative session.

State Rep. Cathy Connolly, the openly lesbian Democrat who sponsored those bills, says Wyoming's strong libertarian streak might be conducive to a legalization of same-sex marriage at some point in the future.

Pearl House Restaurant specializes in making Taiwanese food and bubble tea. They are located just off of Kingsway in South Burnaby.

I stopped by for a quick lunch to fill my insatiable need for noodles and bubble tea.

Taro Slush with Pearls

I ordered a taro slush with pearls ($5). This was my first time ever trying a taro bubble tea drink. I didn?t really know what to expect from it, but I ended up loving it. Although this isn?t a reason to order the drink, I also thought the colour was very pretty.

I?m not sure exactly how to describe taro flavour, but it was mild and sweet. This drink also had a thick texture, almost like a milkshake.

For lunch I had the beef sirloin with regular noodles in soup ($7.50). Everything about this soup was excellent.

The noodles were nice and chewy and there was a good-sized portion of them (enough to fill you up and a good noodle to broth ratio). The beef sirloin was tender and it pulled apart easily. The broth had a rich beef flavour and a hint of spice.

I had a great meal at Pearl House and everything was affordable and filling. Pearl House made one of the better Taiwanese beef noodle soups that I have had, so I would recommend trying it.

UC Davis researchers say emergency room visits remained stable during the last big Sacramento area-wide sprayings for West Nile virus

(SACRAMENTO, Calif.) In what researchers say is the first public health study of the aerial mosquito spraying method to prevent West Nile virus, a UC Davis study analyzed emergency department records from Sacramento area hospitals during and immediately after aerial sprayings in the summer of 2005. Physicians and scientists from the university and from the California Department of Public Health found no increase in specific diagnoses that are considered most likely to be associated with pesticide exposure, including respiratory, gastrointestinal, skin, eye and neurological conditions.

The study evaluated emergency room visits in Sacramento County hospitals on days that pesticides were sprayed as well as the three days following spraying.The study appears in the May-June 2013 issue of Public Health Reports.

This week, mosquito control officials said the region's recent rainstorms and warming temperatures have increased stagnant water and favorable conditions for mosquitoes, which will likely magnify the incidence West Nile virus and the risks of human transmission. The mosquito-borne disease first appeared in the state about 10 years ago. It already has been detected in dead birds and mosquitoes in at least 10 counties in recent weeks, including Sacramento and Yolo. However, the adult mosquito population has yet to increase to levels that require aerial spraying over heavily urbanized areas as was done in the Sacramento region in previous years.

"Unfortunately, West Nile virus is endemic in California and the United States, and the controversy of mosquito management will likely arise every summer," said Estella Geraghty, associate professor of clinical internal medicine at UC Davis and lead author of the study. "Findings from studies such as this one help public health and mosquito control agencies better understand the risks and benefits of their practices."

West Nile virus has become an increasingly serious problem throughout the United States and may become more of a threat as the climate warms. According to the Centers for Disease Control and Prevention, West Nile virus is the leading cause of viral encephalitis in the United States. The virus is transmitted to humans and animals through the bite of an infected mosquito. Mosquitoes become infected with the virus when they feed on infected birds.

In California around the time of the study -- 2004 and 2005 -- hundreds of people were sickened by West Nile virus and 48 died. Most people exposed to the disease do not have symptoms, but in about 1-in-150 people it can be fatal or result in permanent neurological effects.

The study evaluated emergency room visits in Sacramento County hospitals on days that pesticides were sprayed as well as the three days following spraying. Spraying was done in north Sacramento over three nights, and in south Sacramento over four nights in August 2005. Data were compared with emergency room visits on other days during the same period as well as from nearby areas that were not exposed to aerial spraying.

Emergency room visits were classified by specific diagnostic categories, including respiratory, gastrointestinal, skin, eye and neurologic diseases. Importantly, they found that exposure to aerial spraying was not associated with increased rates of emergency department visits for any of these conditions.

More than 250,000 emergency room visits were analyzed and stratified by 785 diagnostic codes. According to Geraghty, because there were so many data points, statisticians predicted that by chance alone, two conditions would appear to have occurred too frequently or too infrequently. In fact, a type of abdominal hernia was found to occur more often than the background rate during the time of spraying, and death and disease due to unusual causes was found to occur less frequently. The authors concluded that because these conditions have no known plausible biological connection with aerial spraying, the results related to these conditions are indeed likely to have occurred by chance.

Integrated mosquito management -- a method to control mosquitoes through targeted interventions based on mosquito biology that includes surveillance of mosquito activity, reducing breeding sites such as neglected swimming pools, and the killing of larval and adult mosquitoes -- are all used in California to control the spread of mosquito-borne diseases such as West Nile virus. When local methods prove inadequate, aerial spraying is used to rapidly reduce large, adult mosquito populations.

During the time of the study, ultra-low volume of pyrethrin insecticide was used for spraying; the chemical is derived from an African chrysanthemumand acts by blocking chemical signals at nerve junctions in insects. It is the same pesticide used to treat head lice in children and to kill fleas and ticks in pets.

Exposure to the pesticide has been reported to pose risks to human health, including skin and eye irritation, respiratory and gastrointestinal disturbances, lethargy, fatigue and dizziness. According to the UC Davis researchers, the exposure to pyrethrin during the urban aerial sprayings in 2005 was minimal due to the use of ultra low volume technology. Coverage required only about three-quarters of an ounce or less of the chemical per acre.

Geraghty cautioned that potential long-term effects of aerial spraying were not addressed in the study and would be extremely difficult to investigate on human populations. She said it would be worthwhile to reproduce the study for other pesticides and spraying techniques.
